“This is where the rubber meets the road,” Ted explains. “The court appoints an investigator, often called a guardian ad litem, to conduct a thorough assessment of the situation. Think of them as detectives for vulnerable individuals. They interview the proposed ward, their family members, caregivers, and anyone else who might shed light on the individual’s capabilities and needs. A medical or psychological evaluation is also conducted to determine decision-making capacity.

“The investigator’s findings are then compiled into a detailed report for the court. This report is instrumental in helping the judge make an informed decision about whether guardianship is necessary and, if so, what type of guardianship would be most appropriate.”
“I recall one case where the proposed ward was a fiercely independent senior who vehemently opposed guardianship,” Ted shares, his expression turning thoughtful. “The investigator spent considerable time building rapport with her, respecting her autonomy while also carefully assessing her cognitive abilities. Ultimately, the investigation revealed that she did indeed require some support with financial decision-making but could still maintain control over her personal life. We were able to secure a limited guardianship that protected her assets while honoring her desire for independence.”
