A Conversation with Ted Cook on Guardianship

Hi everyone, today I’m joined by Ted Cook, a guardianship attorney here in sunny San Diego. Ted, thanks so much for taking the time to chat with me.

So, Ted, what exactly is a guardianship and why might someone need one?

Well, a guardianship is essentially a legal arrangement where someone is appointed by the court to make decisions for another adult who is unable to do so for themselves. This could be due to a variety of reasons, such as dementia, mental illness, or severe physical disabilities.

Let’s delve into one of the crucial steps in this process – Court Investigation and Evaluation. Can you tell us more about that?

Absolutely! The court wants to make sure that guardianship is truly necessary and that the proposed guardian is a suitable choice. So, they appoint an investigator or someone called a “guardian ad litem” who digs into the situation.

  • The investigator interviews the individual who might need a guardian, often referred to as the “proposed ward.”
  • They’ll also talk to family members, caregivers, and even professionals involved in the proposed ward’s care.

“Sometimes,” Ted explains, leaning forward conspiratorially, “the investigator might even drop by the proposed ward’s home unannounced to see how they are living. It can be a bit intense, but it’s all about ensuring that everyone is protected and that the right decisions are made.”

I asked Ted if there have ever been any hiccups during this investigative phase. He chuckled, recounting a time when he had to track down a missing family member who was crucial to the case. “It involved a lot of detective work and late nights,” he admitted with a grin, “but ultimately we found them and were able to gather the information the court needed.”

Courts typically require that less restrictive alternatives—such as powers of attorney, supported decision-making arrangements, or advance directives—be thoroughly explored and deemed ineffective or unavailable before appointing a guardian or conservator.
