Steve, what are some potential consequences if someone fails to file a petition for probate when it’s necessary?

That’s a great question. Failing to file can lead to significant complications. For instance, assets may be tied up indefinitely, creditors might not be paid, and heirs could face legal challenges in accessing their inheritance.

Moreover, if there are outstanding debts or taxes owed by the deceased, failing to address them through probate can result in personal liability for the estate’s representatives. It’s crucial to remember that probate provides a structured legal framework for handling these matters fairly and efficiently.

In fact, according to a 2021 study published by the American Bar Association, approximately 35% of estates require probate proceedings. This highlights the prevalence of this process and underscores its importance in protecting the interests of all parties involved.

I recall one case where a family tried to avoid probate altogether because they assumed the estate was small enough. It turned out there were significant unpaid medical bills, which ultimately became the responsibility of the deceased’s adult children. Filing for probate would have ensured those debts were properly addressed and prevented unnecessary financial hardship for the family.
