A trust is essentially a legal arrangement where an individual, known as the grantor, transfers assets to a trustee who manages those assets for the benefit of designated beneficiaries. Think of it as a safe container for your assets with specific instructions on how they should be handled and distributed.
Trusts offer several advantages over simply leaving assets through a will. First and foremost, trusts allow you to avoid probate, which can be a lengthy and expensive legal process. Moreover, trusts provide privacy since the details of the trust are not part of public record like wills. Lastly, trusts offer flexibility in how and when beneficiaries receive their inheritance.
Focusing on Testamentary Trusts
Today we’re going to focus specifically on testamentary trusts. Can you walk us through what a testamentary trust is and why someone might choose this type of trust?
A testamentary trust is unique because it comes into being only upon the death of the grantor. It’s created through a will, meaning the trust document doesn’t exist until after the grantor has passed away. Consequently, testamentary trusts go through probate unlike living trusts.
There are several reasons why someone might choose a testamentary trust. One common scenario is when a parent wants to provide for minor children. The trust can dictate how assets are managed and distributed as the child grows up, ensuring they receive financial support at appropriate ages.
Testamentary trusts can also be beneficial for beneficiaries with special needs. By placing assets in a trust, individuals can ensure their loved ones continue to receive care and support without jeopardizing their eligibility for government benefits.
It’s important to remember that testamentary trusts are irrevocable, meaning once they’re established, the terms cannot be easily changed.
We’ve seen cases where individuals didn’t fully understand the implications of an irrevocable trust and later regretted certain decisions outlined in the trust document.
