Steve, could you explain one of the key steps in the probate process for our viewers?
“Certainly,” says Steve. “One crucial step is what we call ‘marshalling estate assets’. This involves a thorough inventory of all assets belonging to the deceased person’s estate. Consequently, this includes everything from bank accounts and real estate to vehicles, jewelry, and personal belongings.
Ordinarily, we start by reviewing financial statements, deeds, titles, and any other relevant documents. We also often need to contact financial institutions and other organizations directly to confirm the existence and value of assets. It’s a meticulous process that ensures all assets are accounted for accurately.”
Steve goes on to explain, “Once we have a comprehensive inventory, we file an Inventory and Appraisal with the court (Forms DE-160/161). This document provides a detailed list of each asset, its estimated value, and any outstanding debts or liens associated with it.”
“Notwithstanding the importance of accuracy in this step, I recall one case where a hidden safety deposit box was discovered only after probate proceedings had begun. The family was unaware of its existence, but luckily we were able to locate it and include its contents in the estate inventory.
This experience highlights the value of thoroughness and diligence during the asset marshaling process.”
